General Terms and Conditions of Sale

Effective as of March 10, 2026


Clause 1: Purpose and Scope

The general terms and conditions of sale described below detail the rights and obligations of the sole proprietorship Pierre Second, registered at 490 Chemin du Lachat, 42360 Panissières (SIRET 928666890 00019), for its business activity "Aventures et Vous !" and its clients in the context of the sale of services (mountain guiding, nature activities, and other sports-related activities).


Clause 2: Prices and Currency

The prices of the services sold are those in effect at the time of booking and are available on the professional's website, as well as upon request by the client, whether written or oral. Prices are listed individually for each type of service. The currency is the euro. The price including VAT is equal to the price excluding VAT, since the sole proprietorship Pierre Second is exempt from VAT, according to Article 293B of the French General Tax Code.

The sole proprietorship Pierre Second reserves the right to modify its prices at any time and undertakes to inform its clients of any changes by any means possible.


Clause No. 3: Discounts and Rebates

The sole proprietorship Pierre Second reserves the right to grant a discount to a client if it observes a service failure that prevents the performance of the service to that client under the conditions usually agreed upon.

The sole proprietorship Pierre Second reserves the right to grant a rebate to a client to reward their loyalty.


Clause 4: Cancellation and Refund

In the event of cancellation initiated by the buyer, the buyer may only request a refund of any advance payments made if the cancellation occurs at least 48 hours before the scheduled service.

The formats ‘Your tailor-made Trek stay’, ‘GRP Terres de Tisseurs’ and ‘Your tailor-made Trail course’ are exceptions to this principle and entitle you to a refund of the supervision, excluding the roadbook option, up to 50% for a cancellation in the last 48 hours.

However, in the event of cancellation initiated by the sole proprietorship Pierre Second, any advance payments made by the buyer for the cancelled service will be fully refunded.


Clause 5: Gift Certificate

The sole proprietorship Pierre Second offers its clients the option of using a gift certificate, subject to the following terms:

- Amount: The value of the certificate is at the discretion of the applicant, up to a maximum of €200 per certificate.

- Use: Each certificate is issued in the recipient's name and is therefore non-transferable. Multiple certificates can be used, provided each is valid. To be valid, a certificate must be handed directly to the professional upon completion of the service. If the value of the certificate exceeds the cost of the service, the professional will deduct the service cost from the certificate's value and return the certificate to the same recipient with any remaining balance. Therefore, a single certificate can be used multiple times if its value allows.

- Details: Each voucher indicates its monetary value, expiry date, the name of the recipient, and a reference number that allows the sole proprietorship Pierre Second to ensure that no counterfeit vouchers are produced and used.

- Validity: The voucher is valid from its purchase date until December 31st of the following year (N+1). The voucher becomes invalid after this date.

Example: A gift voucher purchased on March 5, 2026, will be valid until December 31, 2027.

- Refunds: No refunds will be issued for lost or unused vouchers during their validity period.

- Extensions: The validity period of the voucher cannot be extended.

- Liability: The sole proprietorship Pierre Second may not, under any circumstances, refuse payment for a service using a voucher if it is used during its validity period, by the named individual on the voucher, and for an amount at least equal to that of the service performed.


Clause 6: Discount

No discount will be granted for early payment.


Clause 7: Payment Methods

Payment for services may be made:

- by credit card, online or directly via a payment terminal (including contactless);

- by bank transfer;

- by cash;

- by check;

- by holiday voucher (digital version accepted), with no change given.

Payment must be made under the following conditions:

- within 30 days, at the latest, from the date the service was performed.


Clause 8: Late payment and collection costs

In the event of total or partial non-payment, the buyer shall pay the sole proprietorship Pierre Second a late payment penalty equal to three times the legal interest rate. The applicable legal rate is that in effect on the date the service was performed.

The penalty is calculated on the total amount remaining due and accrues from the payment due date without any prior formal notice being required.

In addition to late payment penalties, any sum, including any deposit, not paid by its due date will automatically incur a fixed compensation of €40 for recovery costs.

Articles 441-10 and D. 441-5 of the French Commercial Code.


Clause 9: Force Majeure

The liability of the sole proprietorship Pierre Second shall not be incurred if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale arises from a case of force majeure. For these purposes, force majeure shall be understood to mean any external, unforeseeable, and irresistible event as defined in Article 1148 of the French Civil Code.


Clause 10: Disputes and Mediation

In the event of a dispute between a client and the sole proprietorship Pierre Second, the parties shall endeavor to resolve it amicably by submitting a formal complaint to the business.

In the absence of an amicable agreement or if the professional fails to respond within a reasonable period of one (1) month, the consumer, as defined in Article L.612-2 of the French Consumer Code, may, if a disagreement persists, refer the matter free of charge to the competent mediator listed by the Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the French Consumer Code, namely:
